Welcome to the WhyQ SG (www.whyq.sg) website and our applications (each our "Service") (“WhyQ SG”, “we”, “us” and “our” refer to “WhyQ Pte Ltd, 06-01 Pacific Tech Center, Singapore 159303”).

  • These Terms and Conditions govern your use of the WhyQ platform and services. By accessing or using our services, you agree to be bound by these terms.

  • WhyQ Pte. Ltd. is a technology platform that facilitates the ordering and delivery of food from various merchants or restaurants. We are not the manufacturer, seller, or distributor of any food or beverage. Our role is limited to providing a platform to connect customers with merchants and arranging for the delivery of orders.
    
    
• 3. Food Quality and Safety
  
  
  • WhyQ does not have control over the ingredients, food preparation or handling, quality of food or beverages provided by merchants. All food-related matters, including but not limited to food safety, and quality, are the sole responsibility of the merchant.
    
    
• 4. Liability
  
  
  • WhyQ is not liable for any loss, damage, injury, or illness arising from the consumption of food or beverages ordered through our platform. Any claims related to the quality, safety, or suitability of food should be directed to the respective merchant.
    
    
• 5. Order Accuracy
  
  
  • While we strive to ensure order accuracy, we cannot guarantee that all orders will be fulfilled exactly as placed. WhyQ will, on a best efforts basis, resolve any discrepancies or errors in orders with the help of the merchant.
    
    
• 6. Delivery
  
  
  • WhyQ will use reasonable efforts to deliver orders within the estimated delivery time. However, we cannot guarantee delivery times and are not liable for any delays or failures to deliver. We recommend inspecting all food items upon delivery and consuming them promptly. We are not responsible for the condition of food after delivery.
    
    
• 7. Intellectual Property
  
  
  • All intellectual property rights related to the WhyQ platform and services belong to WhyQ Pte. Ltd.
    
    
• 8. Our Right to Vary These Terms and Cconditions
  
  
  • WhyQ may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.
    
    
• 9. Events Outside Our Control
  
  
  • No party shall be liable to the other for any delay or non-performance of its obligations under this Agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion.

  • Neither you, WhyQ nor the Partner Merchant shall be responsible to the others for any delay or non-performance of its obligations under this agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion.
    
    
• 11. Severability
  
  
  • If any provision of this agreement is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced
    
    
• 12. Entire Agreement
  
  
  • These terms contain the whole agreement between the parties relating to its subject matter and supersede all prior agreements, arrangements and understandings between the parties relating to that subject matter.
    
    
• 13. Law and Jurisdiction
  
  
  • The Singapore courts will have jurisdiction over any claim arising from, or related to, any use of our Services. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Singapore.

You may not use our Site or our Service in any way that breaches any applicable local, national or international law or regulation or to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards.   • Failure to comply in these Terms of Use constitutes a material breach of the Terms of Use, and may result in our taking all or any of the following actions:
    
    a) immediate, temporary or permanent withdrawal of your right to use our Service;
    b) immediate, temporary or permanent removal of any posting or material uploaded by you to our Service;
    c) issuing of a warning to you;
    d) legal action against you including proceedings for reimbursement of all costs on an (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
    
    disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
    The responses described in this clause are not limited, and we may take any other action we reasonably deem appropriate.
